Terms of Service
Effective date: [set on publication]
Weather safety comes first
Never rely on StormSouth alone to keep you safe.
StormSouth works hard to warn you fast, but an alert can arrive late, not arrive at all, or be wrong. Phones, networks, app stores, operating-system settings, battery saving, our servers and our data sources (including the National Weather Service) can all fail or be delayed.
- Have more than one way to get warnings: a NOAA Weather Radio, your phone's built-in Emergency Alerts, local TV and radio, and outdoor sirens.
- Follow official warnings from the National Weather Service and instructions from local officials. They come first.
- In an emergency, call 911.
Forecasts are predictions, and weather changes quickly. Use your own judgment, and don't put off taking shelter while you wait for an alert.
The agreement
These terms are an agreement between you and StormSouth Media, LLC, a Georgia company ("StormSouth", "we", "us"). They cover the StormSouth app, its widget and stormsouth.app. By using any of them, you agree to these terms and to our Privacy Policy. If you don't agree, please don't use StormSouth.
The Disputes section below asks you to resolve disputes through individual arbitration, not in court or as part of a class action. You can opt out within 30 days.
Age. StormSouth is for a general audience. If you're under 18, a parent or guardian should review these terms with you. The app isn't directed to children under 13.
Changes. We may update these terms. We'll post the new version with a new effective date, and tell you in the app if a change is significant. Using StormSouth after a change means you accept it.
Using StormSouth
Your license. We give you a personal, non-exclusive, non-transferable, revocable license to use StormSouth on devices you own or control, for your own non-commercial use.
What you may not do. Don't:
- copy, scrape, resell or redistribute our forecasts, radar, maps or other content, or use them in another product or service;
- reverse-engineer the app, or get around any of its security or limits;
- overload, attack or interfere with our servers, or access them other than through the app and website;
- use StormSouth to break the law or to harm anyone.
Ads and sponsors. StormSouth is free because it shows ads. Sponsors and advertisers are responsible for their own ads, offers and websites, and we don't endorse them. Severe weather alert screens never carry ads.
Data from others. Much of what StormSouth shows comes from other sources, such as the National Weather Service, NOAA, Open-Meteo and Mapbox. We don't control them and can't guarantee them. Links to other websites are for convenience; their own terms apply.
Changes to the service. We may change, add or remove features, or stop offering StormSouth in some places or altogether, at any time.
App stores. If you got StormSouth from Apple's App Store, Apple's Licensed Application End User License Agreement also applies, and these terms add to it. These terms are between you and us, not Apple or Google. Apple and Google aren't responsible for StormSouth, its support or any claims about it, and have no duty to maintain it. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
Our content and yours
Ours. The StormSouth app, website, name, logos, design, radar imagery we produce and the way we present weather belong to us or our licensors, and are protected by law. These terms don't give you any rights to them beyond the license above.
Others'. Third-party data, maps, images and trademarks belong to their owners and are used under their terms; the app credits them in Settings → About. Team names and logos belong to their teams and leagues, and showing them doesn't mean they endorse StormSouth.
Your feedback. If you send us ideas or suggestions, we may use them freely, without paying you or owing you anything.
Disclaimers and limits of liability
As is. STORMSOUTH, INCLUDING EVERY FORECAST, ALERT, RADAR IMAGE, MAP AND NOTIFICATION, IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE FULLEST EXTENT THE LAW ALLOWS, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, TIMELINESS AND NON-INFRINGEMENT. WE DON'T PROMISE THAT STORMSOUTH WILL BE UNINTERRUPTED, ERROR-FREE OR DELIVER ANY ALERT, OR THAT ITS INFORMATION WILL BE ACCURATE OR COMPLETE.
Limits. TO THE FULLEST EXTENT THE LAW ALLOWS, STORMSOUTH MEDIA, LLC AND ITS OWNERS, EMPLOYEES, CONTRACTORS, DATA PROVIDERS AND SPONSORS WON'T BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY PERSONAL INJURY, DEATH, PROPERTY DAMAGE OR OTHER LOSS ARISING FROM A FORECAST, AN ALERT THAT WAS LATE, MISSING OR WRONG, OR YOUR USE OF OR RELIANCE ON STORMSOUTH, EVEN IF WE WERE TOLD IT WAS POSSIBLE. OUR TOTAL LIABILITY FOR ALL CLAIMS IS LIMITED TO THE GREATER OF WHAT YOU PAID US IN THE LAST 12 MONTHS OR $50.
Some states don't allow some of these exclusions or limits, so they may not all apply to you. Nothing here limits liability that the law doesn't allow us to limit.
Indemnity. If you misuse StormSouth or break these terms and someone makes a claim against us because of it, you agree to cover our reasonable costs of that claim, including legal fees.
Disputes
Talk to us first. Most problems can be fixed by email. Before starting a formal dispute, send us a written description to legal@stormsouthmedia.com and give us 60 days to try to resolve it.
Individual arbitration. If we can't resolve it, you and we agree that any dispute about StormSouth or these terms will be settled by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, not in court. The arbitrator can award the same individual relief a court could. For claims under $10,000 we'll pay the filing and arbitrator fees, unless the arbitrator finds the claim frivolous. You may choose to hold the arbitration by video, by phone, on written submissions, or in your home county.
No class actions. Disputes are brought only individually, never as a plaintiff or class member in a class, collective or representative proceeding. If this waiver is found unenforceable for a claim, that claim goes to court, not to class arbitration.
Exceptions. Either of us may bring an individual claim in small-claims court instead, and either of us may go to court to stop infringement or misuse of intellectual property.
Opting out. You can opt out of arbitration by emailing legal@stormsouthmedia.com within 30 days after you first accept these terms, saying you opt out. Opting out doesn't change anything else in these terms.
Governing law. Georgia law and the Federal Arbitration Act govern these terms, without regard to conflict-of-law rules. Anything that goes to court, other than small claims, will be heard in the state or federal courts located in Georgia, and you and we consent to their jurisdiction.
Time limit. To the extent the law allows, a claim must be brought within one year after it arises.
Ending this agreement
You can stop using StormSouth at any time by deleting the app. We may suspend or end your access if you break these terms or misuse the service. The sections on our content, disclaimers and limits, and disputes keep applying after the agreement ends.
General
These terms and the Privacy Policy are the whole agreement between you and us about StormSouth. If a court finds part of them unenforceable, the rest still applies. If we don't enforce a term right away, we haven't waived it. You can't transfer these terms to someone else; we may transfer them as part of a merger or sale of our business. Neither of us is responsible for delays caused by events outside our reasonable control.
